Default Attorney Retained Process

These are additional processes that you can add to your LMS tenant to help streamline your loan servicing. You can either set them up yourself using process wizards, or reach out to your success specialist to enlist the help of our support engineers (tech support rates may apply).

A major function of LoanPro's Loan Management System is to make common company processes as streamlined and effective as possible. Our process wizards make processes easier for your team and improve the chances they are completed successfully. This article will cover the process for inputting a borrower's attorney's information and how LoanPro makes it a breeze for your personnel.

Default Attorney Retained Process

Under certain circumstances, a borrower may need to hire legal counsel. A borrower may retain an attorney to make fraud, credit, or collections disputes, or to make cease and desist requests. In most circumstances, an attorney is retained in the event that a borrower is filing for bankruptcy. If a borrower is filing for bankruptcy or hires legal counsel for another reason, the lender will be made aware, and the attorney's information will need to be stored. We'll break down the process of doing so below.

The flow chart below outlines all the changes and processes implemented by LoanPro directed by the agent user's inputs in the wizard. The agent user's role is outlined in this article.

Starting the Process

In the event that a customer informs the company of an attorney retained, the agent managing the customer's account can enter the specific loan and navigate to the 'Wizards' tab. This page shows all the process wizards available for use on the account. Some of the process wizards have certain requirements in regards to the loan that must be meet in order to start the process wizard. Click the 'Category' drop-down and select 'Attorney Retained Wizard'.

In order for this wizard to be opened, the loan must be in an 'Open' status. If the loan meets this requirement, click OPEN and START to begin the process.

On the first page, enter in all the known and relevant information regarding the attorney. In order for the Attorney Retained Process to proceed, the field 'Attorney Retained' must be set to yes and the fields 'Attorney Retained Type', 'Attorney Name', 'Attorney Address', 'Attorney Phone', 'Attorney Email' must all be populated with information. Click SAVE in the top right and then NEXT to proceed to the next step.

Select an appropriate Action and Result, then document any further information regarding the attorney and/or conversation with the customer in a note. Once the information has been saved, click NEXT to complete the process.
